There are 11 states and Washington, DC where Medical Aid-in-Dying (MAiD) is a legal procedure. MAiD is an important end of life option for terminally ill Americans.
First available in Oregon in 1997, MAiD is now available in 12 US jurisdictions. And the pace of legal development is accelerating. New legislation and judgements are further expanding access to MAiD. In May 20, 2025 Delaware passed the End of Life Options Act. New York’s Medical Aid in Dying Act (A136/S138) was passed by the Assembly in a historic 81-67 vote on April 29; and passed the Senate on a 35-27 on June 9. The bill is waiting for the Governor Kathy Hochul for her signature before it becomes law.
There are only two states which do not require the patient to be a resident, Oregon and Vermont. Shown below are the jurisdictions where MAiD is available for a qualified terminally ill person.
